Five acres along East Bend Road can now be developed for low-density residential use after the Boone County Fiscal Court voted 3-0 on Tuesday, July 28, to approve the Mynhier family's rezoning request.

Judge/Executive Gary W. Moore signed Ordinance 2026-11 into law at the court's meeting in Burlington, completing a two-reading process that began with a first reading on July 14. The property at 10090 East Bend Road, owned by Kirby and Charmaine Mynhier, shifts from Agriculture (A-1) and Agriculture/Small Community Overlay to Rural Suburban Estates (RSE), a designation that permits lower-density residential lots.

As we reported July 19, the court unanimously advanced the rezoning on first reading at its July 14 session. The Boone County Planning Commission had already held a public hearing and recommended approval.

The court's three commissioners, Cathy H. Flaig, Chet Hand, and Jesse A. Brewer, make up the voting body. The signed ordinance records only the aggregate 3-0 tally, not individual votes. Fiscal Court Clerk Shona Schulkers attested the document.

Golf carts coming to two more Rivers Pointe streets

At the same meeting, the court gave first reading to Ordinance 2026-12, which would add Topaz Trace Court and Emerald Falls Court to the list of streets in the Rivers Pointe subdivision where golf carts may legally operate.

The expansion continues a pattern that dates to 2019, when the county first authorized golf cart use on select Rivers Pointe roads under Ordinance 2019-17. The original ordinance has been amended at least 10 times since then as the subdivision has grown. The most recent prior addition came in April 2025.

Moore has described the trajectory before. In the court's October 12, 2021, meeting minutes, he noted that "as new streets were being developed, they would be added to the Ordinance" and that the subdivision was "becoming a golf cart community, like some others in the county."

The golf cart ordinance still needs a second reading before it takes effect. Based on the court's standard biweekly meeting schedule, that vote is expected around Tuesday, August 11.
